The following General Terms and Conditions and any other rules posted on our Site (collectively the "GTC") constitute an agreement between Unisus ClubKft. ("we", "our", "us") and You, the visitor, ruling Your access and use of all content and functionalities available at the UNISUS CLUBonline store, related micro-sites accessed through the URL www.unisusclub.com , related domain names, and any other online store or micro-site of Unisus Club(collectively the "Site").

By visiting the Site, you are accepting and consenting to the rules and conditions described in our GTC. We may modify the GTC from time to time and your continued use of this Site (or any of our other Sites) following such change shall be applicable to your agreement to be bound by the modified GTC.

This GTC is in effect from 1 Oct 2023 and shall be effective until withdrawal.

Those persons wishing to use our services must read and agree to be ruled and obliged by our terms relating to the services of our online store. We draw your attention to our policies relating to the terms of purchase. If you are under 18, you must let your parent or legal guardian know and agree Unisus Club’s GTC.

Please read the GTC and check it to time to time. If you do not agree to any modification to the GTC, then you must stop using the Site promptly.

If case any parts of our GTC are unclear, or if You have any questions, please contact us before You place an order in our online store. The governing law of our GTC is Hungarian law. The language of this GTC and that of the contractual relation between You and Unisus Clubis the English language. Each customer order establishes a unique contractual relation between You and Unisus Cluband Unisus Clubis not ruled by any code of conduct. Please note this GTC is entered only in electronic form, and shall not deemed as a written contract.

You can place an order and purchase products in our online store with or without registration.

To use some of the services or features made available to You on this Site you will need to register for an account. When you register, you must provide information about yourself that is true, accurate, current and complete in all respects. Should any of your registration information change, please notify us immediately at the following e-mail address: customer@unisus.club. We may also change registration requirements from time to time. In case of registration, we send an automatic email to confirm your registration.

We ensure that the shopping procedure is simple and secure. To create an account, simply click on SIGN IN and then REGISTER NOW to fill in Your details. If you order and purchase products with registration, upon registration you declare that you are older than 18 years, are aware of and accept this GTC and other policies and regulations published on our online store, and you give your consent to manage and process your personal data as described in our Privacy Policy. In case of ordering and purchasing products without registration, you must complete the procedure only if you declare that you acknowledge and accept this GTC, and you give your consent to manage and process your personal data as described in our Privacy Policy.

In case of invalid or non-existent data the contract with us shall be null and void. Unisus Clubexcludes its liability in case you purchase goods and/or use our services with another person’s data. We are not liable for damages occurred since you forgot your password, or such password became available to a third person out of the scope of the responsibility of our company. Unisus Clubshall not be liable for late delivery if it was caused by incorrect and incomplete data provided by you. Please protect your password and user’s name. The account password you create must be unique and kept secure. You must notify Unisus Club immediately in case you experience any breach of security or unauthorized use of your account. In case you have any issues with your account or need any help in relation to it, then please contact us, but please note that we can communicate only with the original account holder in relation to any issue related to the registered account.

If you forgot your password, please follow the instructions on the Sign in page. For security reasons we are unable to send your password via email. Please note to our Privacy for information about how we use your data.

The purchase of merchandise through Unisus Club is strictly applicable to parties who can lawfully enter and form contracts on the Internet accepting the laws of Hungary, European Union as ruling jurisdiction.

Placing an order after registration you can enter our online store and begin shopping. You can choose the products for purchase, the colour, the size and the quantity and put the products into your cart. Unisus Club provides the name and description of the products along with a photo in the online store. Small difference can occur between the photo and the product itself. Unisus Club is not liable for the differences between the photo of our product on our online store and the real appearance of the product. The content of Your cart can be found by clicking on the “Cart” icon. Items in your cart are not reserved and can be purchased by other customers. If You have a discount code, it can be used with Apply button, to reduce the purchase price with the discount amount in case it is applicable to your purchase. By checkout, you your billing address, which can differ from the shipping address. The next step is to select the shipping method. During checkout, the shipping fee will be calculated since the shipping address.

You can pay by multiple payment methods. All transactions are secure and encrypted. Credit card information is never stored by Unisus Club. Payments are made in EUR. Please check the currency settings for your chosen shipping country for more information. By clicking on “Complete order” button you can pay the purchase price of the cart. When placing your order, the purchase price, the shipping fee and all other applicable fees (if any) will be indicated that you must pay to receive the products. After placing an order and successfully completing the checkout process, you must be redirected to an order confirmation page and Unisus Club  sends you an order confirmation email without delay, but not later than within forty-eight (48) hours from the time of the order. Usually, this message is shown in the online store window after the payment method was successfully completed, with the wording “Your order is confirmed”. Such email contains your order’s summary. Unisus Club is not liable for late confirmation if the confirmation delay is due to an incorrect email address provided during the registration process, or your email account is not able to accept messages because your inbox is full. This confirmation email is not an acceptance of your order, it is only a confirmation that Unisus Club  has received your order. Acceptance of your order shall be completed when Unisus Club  sends an order Confirmation and shipping notification email to you to confirm that the items have been sent to you. When you would like to continue your shopping in the online store after placing an order, click on the “Continue shopping” button.

Please note, that purchase prices include value added tax (VAT) in accordance with Hungarian tax rules, but do not include shipping fees. Shipping fees are displayed separately based on your shipping destination. All purchases are made in EUR. In case your bank account is in a different currency, then your bank might include some additional fees and use its own exchange rate. We are not responsible for possible exchange fees in these cases. If you are unsure about the procedures your bank is following in case of such transaction, we suggest contacting your bank for further information. Charges on your bank statement will appear as “Unisus Club Kft. or Unisusclub.com”.

We reserve the right not to accept your order in the event, for example, that we are unable to obtain authorization for payment, that shipping restrictions apply to a particular item, that the item ordered is out of stock or does not satisfy our quality control standards and is withdrawn, or that you do not meet the eligibility criteria set out within the GTC. We may refuse to process a transaction for any reason or refuse service to anyone at any time at our sole discretion. We will not be liable to you or any third party by reason of our withdrawing any merchandise from the Site whether that merchandise has been sold, removing, screening or editing any materials or content on the Site, refusing to process a transaction or revoking or suspending any transaction after processing has begun. Whilst every effort is made to make sure details on our online store are accurate, we may from time to time discover an error in the pricing of products. If we discover an error in the pricing of a product in your order, we will let you know as soon as possible. We shall be under no obligation to accept or fulfil an order for a product that was advertised at an incorrect price and reserve the right to cancel such an order that has been accepted or is in transit. If you order a product that is priced incorrectly for any reason, we will contact you to inform you that we have not accepted your order and/or that the relevant part of your order has been cancelled. If you have already paid for the goods, we shall refund the full amount as soon as we are able. If products are recalled in transit, we will process your refund once the products have been returned to us.

Unisus Club accepts many kinds of payments including several bank cards, PayPal, Alipay etc. If the issuer of your payment card refuses to authorize the payment to Unisus Club, we shall not be liable for any delay or non-delivery. The total amount to be paid includes all costs based on your order and the confirmation email. The invoice shall be sent to you electronically in email.

This online store is available only to individuals and others who meet the Unisus Club terms of eligibility, who have been issued a valid credit/debit card by a bank acceptable to Unisus Club, and who have authorized Unisus Club to process a charge or charges on their credit/debit card in the amount of the total purchase price for the merchandise which they purchase. Products purchased by the buyer are for personal or gift use and should not be re-sold, used for commercial purposes or any other commercial benefit. In addition, Unisus Club reserves the right to restrict multiple quantities of an item being shipped to any one customer or postal address. The delivery of the products is made by Unisus Club worldwide through the courier services. We ship worldwide, with some exceptions. For details please contact us.

By making an offer to purchase merchandise, you expressly authorized us to perform credit checks and, where Unisus Club feels necessary, to transmit or to obtain your credit card information or credit report information (including any updated information) to or from third parties solely to authenticate your identity, to validate your credit/debit card, to obtain an initial credit card authorization and/or to authorize individual purchase transactions.

Furthermore, you agree that we may use Personal Information provided by you in order to conduct appropriate anti-fraud checks. Personal Information that you provide may be disclosed to a credit reference or fraud prevention agency, which may keep a record of that information.

All orders are subject to acceptance and availability, and Items in your shopping basket are not reserved and may be purchased by other customers.

Unisus Club offers products for sale that are in stock and available for dispatch from our distribution centre.

However, from time to time, we may be waiting for shipments from our suppliers. Consequently, you may be given the possibility of making a Preorder with Advance Payment for certain items in which case you are able to make a Preorder Advance Purchase. This will ensure that you receive this item in priority once stock has been delivered to Unisus Club. Unisus Club will only take Advance Purchase orders for stock that has been scheduled for delivery. Your rights regarding Advance Purchase are the same as those for any other purchase at Unisus Club. Alternatively, you may simply choose to register your email address for notification of arrival of the selected merchandise not held in stock.

Items received into stock may be pre-allocated to satisfy Preorder Advance Payment orders and customers making Advance Payments will receive items in priority to customers on the Waiting List or customers ordering through the Site for immediate delivery. Please be aware that we may be unable to deliver selected Preorder Advance Payment merchandise due to production problems or quality check issues identified when we receive an order into stock. In these circumstances we will notify you by email and refund the Preorder Advance Payment to your credit/debit card within thirty days of being advised that merchandise has become unavailable.

If you have registered your email address for notification of the arrival of a specific product featured on our Site, we will attempt to notify you by email within 48 hours of the product becoming available on the Site. Please note that on occasion certain products that are in particularly high demand will sell out during this period.

Unisus Club will store a record of your transactions for a minimum of one year.

From time to time, prices are subject to change in response to currency exchange rate changes, markdowns and other commercial factors. The price applicable to your order will be the price current at the time your order is accepted.

Customers will be charged for the items purchased and shipping costs only. Import duty or tax costs will be invoiced to you directly from DHL or an import broker appointed by you. We recommend you contact your local customs authority to determine a landed cost price prior to purchase completion. Unisus Club is based in European Union, within EU there is no custom duty payment.

If you are a customer whose credit/debit card is not denominated in EUR, the final price will be calculated in accordance with the applicable exchange rate on the day your card issuer processes the transaction.

Regardless of your shopping destination and the currency you shop in, your purchase may be processed by one of our regional affiliate companies in which case your bank may charge you an international transaction fee. Unisus Club is not responsible for any such fee or charge. 

Promotion codes are non-transferable and there is no cash alternative. Furthermore, they cannot be used in conjunction with any other promotion code or offers, and must be redeemed by the date published, if provided.

You will own the goods on and from the later of the point in time when: (a) we receive payment in full, or (b) we deliver the goods to you.

Unisus Club ensures each purchase during the time it is in transit until it is delivered to your specified delivery address. We require a signature for any goods delivered, at which point responsibility for your purchased goods passes to you. If you have specified a recipient who is not you for delivery purposes (for example as a gift) then you accept that evidence of a signature by them (or at that delivery address) is evidence of delivery and fulfilment by UNISUS CLUB, and transfer of responsibility in the same way. The goods are your responsibility from the time we deliver them to the address you gave us.

The signature can be waived for domestic orders dispatched via local courier. When placing an order, the signature requirement is set by default; however, you can update your preference on the shipping page before proceeding to purchase. Please note, that if no signature is collected, you agree to our terms and conditions and, confirm that Unisus Club can leave your package(s) outside the premises at the shipping address provided by you without obtaining a signature for proof of delivery. You authorise Unisus Club to leave the package(s) at the shipping address without obtaining a signature and release and indemnify Unisus Club from liability for any loss or damage that may result from leaving the package(s) at your shipping address without obtaining a signature.

Please note that we aim to dispatch all orders within 24 hours, or 48 hours during sale periods. Delivery times appearing on the Site are estimates and are to be used as a guide only and commence from the date of dispatch. In any event, we will deliver the goods to you within 30 days of the day on which we accept your order. Unisus Club is not responsible for any delays caused by destination customs clearance processes.

If delivery is delayed by any event outside of our control, we will contact you as soon as possible to let you know and we will take steps to minimize the effect of the delay. Provided we do this, we will not be liable for delays caused by the event, but if there is a risk of substantial delay you may contact us to cancel your order and we will give you a refund for any goods you have paid for.

ARRANGING YOUR EXCHANGE OR RETURN

You must request your exchange or return and send your unwanted items back to us within 30 days for a refund of the value of the item only, or an exchange on the same item in a different size, based on stock availability.

In case of returning defective items, the shipping fee is paid by Unisus Club and a pick-up is organized by Unisus Club. Unisus Club’s couriers deliver the new product during replacement of defective items. In this case, the shipping fee and the customs clearance fee are paid by Unisus Club. When the product has been proven to be defective, Unisus Club shall pay back the whole amount of purchase price to you in the same payment method as the original payment was made, including the shipping fee. In the case of exchanging or returning products to Unisus Club, we offer free returns on orders that meet the free shipping threshold. Otherwise, the customer must cover the costs of returning products to Unisus Club. However, please note that we are not accepting returns outside of the EU via regular post, please contact our customer service if you’d like help with choosing the right delivery company for your return shipment. The new product chosen by you for exchange, will be delivered to you by Unisus Club ’s couriers and the delivery fee is paid by Unisus Club. However, you can only request an exchange for the same product in a different size. Unisus Club preserves the right to reject any confirmed orders, for example when the item is out of stock due to inventory errors, or its condition does not satisfy our standards regarding its quality. In such a case Unisus Club will inform you without delay. In this case, Unisus Club shall refund the whole amount paid by you for the item(s) we are unable to fulfil without delay, but not later than thirty (30) days. When any defect occurs in our online store in relation to products or prices, Unisus Club maintains its right to correction. In this case Unisus Club informs you about the new data without delay. You can then confirm your order once again, or any party is entitled to withdraw from the contract.

We may, in our sole discretion, limit or cancel quantities purchased per person. If we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made. We reserve the right to restrict multiple quantities of an item being shipped to any one customer or postal address. Unisus Club is not liable for the case when its suppliers do not fulfil or essentially modify their obligations towards Unisus Club. Unisus Club preserves the right to partially or wholly refuse the confirmed orders, after consulting with you. Right of withdrawal You can announce your right of withdrawal within 30 days of receiving your original order without reasoning. You announce such right in an expressed statement sent to the Customer Service Team (customer@unisus.club) within the above 30 day deadline. You shall send back the item to us without delay, but within the initial 30 days upon delivery. If your order is not applicable for a free return label, then make sure to keep the proof of mailing of the parcel. The deadlines above shall be regarded as being complied with if you send your statement or the item before the 30 days has expired. As Unisus Club  receives the returned item, a quality control procedure shall take place in order to determine the appropriateness of the returned item. Unless your order is eligible for a free return, you will be responsible for return shipping costs. Shipping costs are non-refundable unless the item is defective. We recommend you obtain a proof of postage and use a trackable shipping service or purchase shipping insurance. We are not accepting returns sent via regular post from outside of the EU. We shall refund the price paid for the returned item once it is received by us. We shall not refund such shipping fee, which was chosen by you and was not in line with our usual shipping method. The refund shall be made in the same way as the original method of your payment was made. You will receive a written notification via email that we have received your returned item. Any item returned exceeding the 30 day deadline will not be eligible for a refund and will be shipped back to the sender.

Custom orders: You are not entitled to exercise the right of withdrawal when the item was prepared especially upon your own instructions, or on your expressed demand, or in case the item was unambiguously personalized to you.

The right of withdrawal cannot be exercised by a non-consumer entity, i.e. an enterprise, namely such entity which acts in the scope of its profession, independent occupation or its business activity

Products marked as "Final Sale" cannot be returned or exchanged.

Please be aware that we will not be held responsible for any items that are returned to us which were not purchased from Unisus Club. This includes personal items as well as items which may have been purchased from other third-party companies. Whilst we will make reasonable efforts to try and locate the owner of any such items, it is your responsibility to contact Customer Care as soon as possible in order to arrange their return to you. In such circumstances, we will charge you an additional cost for returning these items. Please note that we will only ever be able to return the items to you directly, and not to any third party or company. Certain items (such as passports, driving licences and bank cards) will always be sent to the relevant authority, bank or government agency directly and you should report any loss of these items to the appropriate office immediately.

We will keep non- Unisus Club items for up to one month, however we reserve the right to dispose of them as we deem fit after this time (which may include donating such items to a charity of our choice). Any hazardous or flammable products, as well as items of little monetary value (e.g. pens, glasses, keys) will be disposed of immediately.

You acknowledge and agree that all copyright, designs, the "look and feel" of the Site, trademarks and all other intellectual property and material rights relating to the Content as herein described, including Unisus Club Software and all HTML and other code contained in this Site, shall remain at all times vested in Unisus Club and/or are the property of their respective owners. All such Content, including third party trademarks, designs and related intellectual property rights mentioned or displayed on this Site are protected by Hungarian and EU laws and regulations and international treaty provisions. You are permitted to use the Content only as expressly authorized by Unisus Club and/or its third-party licensors. Any reproduction or redistribution of the above listed Content is prohibited and may result in civil and criminal penalties. Violators will be fully prosecuted permissible under applicable law. Without limiting the foregoing, copying and use of the above listed materials to any other server, location or support for publication, reproduction or distribution is expressly prohibited.

This Site is for your personal non-commercial use only. You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, commercially exploit, create derivative works from, transfer, or sell any Content, software, products, or services contained within this Site. You may not use this Site, or any of its Content, to further any commercial purpose, including any advertising or advertising revenue generation activity on your own Site.

You use this Site at your sole risk. You agree that you will be personally responsible for your use of this Site and for all your communication and activity on this Site. We reserve the right to deny you access to this Site, or any part of this Site, at any time without notice. If we determine, in our sole discretion, that you engaged in prohibited activities, were not respectful of other users, or otherwise violated the GTC, we may deny you access to this Site on a temporary or permanent basis and any decision to do so is final.

You agree that you shall not remove, obscure, or alter any proprietary rights notices (including copyright and trademark notices) which may be affixed to or contained within the Site.

You agree not to collect or harvest any personally identifiable information, including account names, from the Site, nor to use the communication systems provided by the Site for any commercial solicitation purposes. You agree not to solicit, for commercial purposes, any users of the Site with respect to any submissions made by them.

We may include hyperlinks on this Site to other online stores or resources operated by parties other than Unisus Club, including advertisers. Unisus Club has not reviewed all of the sites linked to its Web Site and is not responsible for the content or accuracy of any off-site pages nor are we responsible for the availability of such external online stores or resources, and do not endorse and are not responsible or liable, directly or indirectly, for the privacy practices or the content of such online stores, including (without limitation) any advertising, products or other materials or services on or available from such online stores or resources, nor for any damage, loss or offence caused or alleged to be caused by, or in connection with, the use of or reliance on any such content, goods or services available on such external online stores or resources. 

Unisus Club is not liable for damages resulting from natural amortization, defect or negligent use, abnormal consumption or misuse or any other treatment that is not suited to the product description or care label. Regarding colours: Although we aim to show and describe our products as accurately as possible, please note that due to the colour settings of your computer the colours seen might be different from the actual colour of the products. In case of defective fulfilment, you are entitled to make a claim for defective items against us based on the Hungarian Civil Code. Upon your decision you are entitled to make the following claims: If an item is defective due to a manufacturing fault, we will offer to repair the item or exchange it. If it cannot be repaired or the same item is not available, you are entitled to a proportional price reduction or to have it repaired it by yourself or a third party and we pay for the repair, or to a full refund (the purchase price along with the shipping fee). You are entitled to modify your chosen claim, but you are responsible for the costs imposed by this modification, except it was caused by us. You shall inform us about the defect without delay, but within two (2) months from the date of its discovery at the latest. Within the first six (6) months from delivery you shall inform us about the defect and confirm that the item was provided by us. Within such six (6) month deadline there is no other condition to make your claim based on the liability for defective items. After the expiry of the above six (6) month period, however, you are required to prove that the defect discovered by you has already existed at the date of delivery. After the expiry of a two (2) year period following the date of delivery, you are not entitled to make any claims based on the liability for defective items.

Liability for defective products: If you are a private person purchaser, you shall also have a right to make a claim against Unisus Club for defective products as described in this clause According to Hungarian law you have to choose between your rights, which means that you can start a claim against Unisus Club  because of defective items (in Hungarian: kellékszavatosság) or defective products (in Hungarian: termékszavatosság). You cannot start a claim against Unisus Club based on both clauses. If a product is defective, you are entitled only to choose to have it repaired by us or require us to exchange the product. You shall inform us about the defect without delay, but within two (2) months from the date of its discovery at the latest. In case of a defective product, you are required to prove the defect of the product. The product is deemed to be defective only if (i) it does not meet the quality requirements applicable by law to the product, or (ii) it does not have the characteristics set out in the description of the product delivered by us. You are entitled to make your claim against us within a two (2) year period following the date of delivery.

Please note, that the above provisions set forth above are applicable only to consumers. Consumer is a private person acting out of the scope of his/her profession or his/her business activity. To non-consumer buyers’ different provisions of the Hungarian Civil Code shall be applied.

The complaint handling process Unisus Club shall achieve an amicable settlement of any complaint you may have through negotiation or any other friendly means. Your complaint can be sent in writing to our address. Unisus Club shall inspect the orally communicated complaint immediately and shall be settled when it is necessary. When you are not satisfied with the result, or the immediate settlement is not possible, a protocol shall be prepared. Unisus Club shall answer every written complaint in writing within thirty (30) days from receipt. In case Unisus Club  does not accept your complaint, it shall give a reasoning thereof. The protocol in respect of your complaint shall be retained by Unisus Club  for three (3) years. We inform you that you can file a consumer complaint against us. If we reject your consumer complaint, you are also entitled to contact The Hungarian Conciliation Bodies, which is competent according to your place of residence or residence: the condition for initiating the proceedings of the conciliation board is that the consumer directly attempts to settle the dispute with the concerned business. Based on the consumer's request, the conciliation body specified in the consumer's request is responsible for the procedure instead of the competent body. The company has an obligation to cooperate in the conciliation board procedure. As part of this, businesses are required to send a response to the conciliation board's invitation, and the obligation to appear before the conciliation board ("ensuring the participation of a person authorized to establish a settlement at the hearing") is recorded as an obligation.

The procedure of the conciliation board starts at the consumer's request. The request must be submitted in writing to the chairman of the conciliation board: the written requirement can be fulfilled by letter, telegram, teletypewriter or fax, as well as by any other means that enables the addressee to store the data addressed to him permanently for a period appropriate to the purpose of the data, and displaying the stored data in unchanged form and content.

The document or its copy (extract) whose content the consumer cites as evidence must be attached to the application, so in particular the written statement of the company about the rejection of the complaint, or, in the absence of this, other written evidence available to the consumer about the attempted negotiation.
